By making available any content submitted through TheSmokeyGeneration.com, you hereby freely grant The Smokey Generation and its affiliates (including the National Smokejumper Association, Fireline Project, and the U.S. Hotshots Association) nonexclusive irrevocable, perpetual, transferable, royalty-free, worldwide license, with the right to sublicense, to use, copy, adapt, modify, distribute, reference, store, cache, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast and otherwise exploit such content in any form, medium or technology now known or later developed, in whole or in part, for any purposes, including for both commercial and non-commercial use. By agreeing to these Terms of Service, you assert that this material is your own and you hold all necessary rights (including copyrights, etc.) to the material and the content therein. You waive all rights of compensation in connection with the submitted material and such use of your name, picture, image, likeness, actions, voice or other personally identifiable information.
In so doing, you understand that any submitted content may be made available to researchers and may be quoted from, published or broadcast in any medium (consisting of all forms of print or electronic media, including the Internet or other emerging, future technologies that may be developed) that The Smokey Generation shall deem appropriate.
In making this gift, you fully understand that you are conveying all legal title, intellectual property, and literary property rights which you have, or may be deemed to have, as well as your rights, title, and interest in any copyright which may be secured under the laws now, or later, in force and effect in the United States of America. You understand that you retain nonexclusive license to all content submitted through this site, and nothing in these terms of service will be deemed to restrict any rights that you may have to use and exploit your content. Your conveyance of copyright encompasses the full rights of: reproduction, distribution, preparation of derivative works, public performance (including digital audio transmission), public display, commercial use, digitization or Internet publication as well as all renewals and extensions.
You also understand and agree that you may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings you submit. You waive the right to approve the final product. You agree that all such submitted portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, are and shall remain the property of The Smokey Generation and that the donation of the photographs, written content, audio, video, and transcription to an appropriate organization or institution may occur in the future.
You further consent to the reproduction and/or authorization to The Smokey Generation to reproduce and use said photographs, videos, and recordings of your voice, for use in all domestic and foreign markets. You hereby release The Smokey Generation, and any of its associated or affiliated companies or organizations, their directors, officers, agents, employees and customers, and appointed advertising agencies/sponsors, their directors, officers, agents and employees from all claims all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, copyright, appropriation of likeness, or defamation.
